The Federal Real Estate Settlement Practices Act (RESPA) requires that any
"lender" with which someone has a dispute, respond to a borrower by
acknowledging receipt of a "qualified written request" within 20 days and
60 days to resolve the problem. |

There are many variations on this theme from the simple one page QWR shown
on HUD's site to over 28 page requests
requesting all information from which to both document the life of loan
history but acquire enough information to do a thorough loan/mortgage audit.
Statutes of limitations need to be kept aware of regarding any TILA (Truth
In Lending Act) or potential RESPA violations, some of which may allow
rescission of the loan. |
